UK Overseas Domestic Worker Visa Application
Apply for a UK Visa as an Overseas Domestic Worker
Individuals who are employed as domestic workers outside the UK may apply for a visa to accompany their employer during a short visit to the United Kingdom. Eligible applicants must be aged 19 or above and must have been working for the same employer in a private household for a minimum of one year. Professions such as housekeepers, drivers, personal caregivers, chefs, and nannies are all covered under this visa category.
Processing Time, Visa Duration and Fees
You may apply for the Overseas Domestic Worker visa up to 3 months before your intended travel date. Typically, a decision is made within 3 weeks when applying from outside the UK. The visa application fee is £682. This visa allows a maximum stay of 6 months in the UK. Please note that this visa cannot be extended. However, exceptions apply if you applied before 5 April 2012 under the previous rules.
Who is Eligible?
To be eligible, you must be employed as a domestic worker by a person who is either a British national usually residing abroad or a foreign national visiting the UK for not more than 6 months. You must accompany your employer or their family, intend to work full-time in a private household in the UK, and plan to return to your home country once your 6-month stay ends. Additionally, your employer is required to pay you at least the UK national minimum wage.
Required Documents
Applicants must provide a valid passport, proof of financial capability (such as salary slips or bank statements for the past 6 months), and an employment verification letter. A signed ‘Appendix domestic worker statement’ is mandatory. Supporting evidence of employment, such as tax payment records, employment contracts, or previous travel endorsements with the employer, may also be required. Non-English or non-Welsh documents must be submitted with certified translations.
How to Apply and Biometric Process
Applications must be submitted online from outside the UK. As part of the application process, biometric data (fingerprints and a photograph) will need to be provided at a visa application centre. Depending on availability, you may choose a priority or super-priority service to receive a quicker decision.
Visa Extension and Settlement (For Applications Before 5 April 2012)
Those who initially applied for the domestic worker visa before 5 April 2012 may be eligible for visa extensions and even permanent settlement in the UK. Extensions can be granted in 12-month increments, and after 5 years of lawful residence, you may apply for indefinite leave to remain. Applicants must meet requirements related to continuous employment, lawful residence, financial independence, and English language proficiency. Dependants can be included in the application.
Know Your Rights in the UK
Once in the UK, your employer must comply with your employment rights, including paying the agreed wage (at least the national minimum wage), granting leave, providing notice of termination, and ensuring you do not work unreasonable hours. Any breach of these rights can be challenged legally through a tribunal or court action. It is recommended to have your employment terms agreed upon in writing before travel.
The Home Office will carefully scrutinise an application for any long term or temporary work visa. If it does not consider that the visa application is a genuine or if it considers that any of the other requirements have not been met, the application will fall for refusal. It is therefore essential that the application is prepared thoroughly and carefully.
